Contest Rules, Terms, and Regulations

Eligibility: The National Wash Your Nose Day – Xlear Nasal Spray Social Media Video Contest (the “Contest”) is open to individuals aged 18 years or older at the time of entry. Employees of Xlear Inc., its affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and their immediate family members and/or those living in the same household of each are not eligible to participate in the Contest. The Contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.

Contest Period: The Contest begins on Sunday, March 3, 2024, at 12:00 am and ends on Sunday, March 17, 2024, at 11:59 pm (the “Contest Period”). All entries must be received by the end of the Contest Period to be eligible to win.

How to Enter:

To enter the Contest, participants must:

• Record a 30-second video of themselves using Xlear Nasal Spray to wash their nose.
• Video content can be creative and should promote washing your nose with Xlear.
• Email video as an attachment to social@xlear.com and include your social media profile handle(s).
• Share the video on their public social media profiles (Facebook and Instagram) and tag Xlear (Facebook – @Xlear, Instagram – @Xlear) and use the hashtags #washyournosewithXlear, #nationalwashyournoseday, and #xlear.
• Ensure the post is visible and accessible to the public.
• Only one entry per person is allowed.

Entry Requirements:

• All entries must feature the use of Xlear Nasal Spray, or they will be disqualified.
• Videos must comply with all terms of service and community guidelines of the respective social media platforms.
• Participants must use appropriate safety precautions while using the nasal spray and follow all product usage instructions.
• Xlear Inc. reserves the right to disqualify any entry that does not meet the requirements or is deemed inappropriate or offensive.

Winner Selection:

• After the contest period ends, the top ten (10) videos will be selected by an internal vote. These will be based on creativity and following the entry requirements. The
  creators of these videos will be notified that they have made the top ten (10)
  and are in the final voting.
• The top ten (10) will be posted to Xlear Inc’s social media pages by Xlear employees and voting will be open to the public for three days beginning Wednesday, March 20, 2024, at 12:00 am and ends on Friday, March 22, 2024, at 11:50 pm.
• Each video will be posted as a separate post. To vote for a video, you, your family, and friends will hit the like button on your individual video’s post on Xlear’s social media page during the voting times listed above. You can like your video on each social medial platform.
• On Tuesday, March 26, 2024, the top three (3) winners will be selected and announced on Xlear’s social media platforms. The winners will be notified via direct message on the social media platform they used for entry within five (5) business days after the end of the Contest Period.

Prizes: Each winner will receive a one-year supply of Xlear Nasal Spray, consisting of twelve (12) 1.5 oz bottles. The prize is non-transferable and cannot be substituted or redeemed for cash. Any taxes on prizes are the sole responsibility of the winners.

Ownership and Usage Rights: By submitting an entry to the Contest, participants grant Xlear Inc. the irrevocable and unrestricted right to use, modify, reproduce, publish, display, distribute, and create derivative works from the submitted videos for promotional purposes, without further compensation or permission. Participants also warrant that they have obtained all necessary permissions and releases from any individuals who appear in the video and authorize Xlear Inc. to use their likeness in connection with the Contest and promotional activities.

General Conditions: Xlear Inc. reserves the right to cancel, suspend, or modify the Contest if fraud, technical failures, or any other factor beyond its reasonable control impairs the integrity of the Contest, as determined by Xlear Inc. in its sole discretion. Xlear Inc. is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Xlear Inc. on account of technical problems or traffic congestion on the internet or at any website, or any combination thereof, including any injury or damage to participant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Contest.

Release and Limitations of Liability: By participating in the Contest, participants agree to release and hold harmless Xlear Inc., its officers, directors, employees, and agents from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Contest or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participant’s participation in the Contest or receipt of any prize.

Winner List: To obtain a copy of the winners’ names or a copy of these Official Rules, send your request along with a stamped, self-addressed envelope to: Xlear Inc. – Social Media Contest, PO Box 1421, American Fork, UT 84003. Requests must be received within thirty (30) days after the end of the Contest Period.

Sponsor: The sponsor of the Contest is Xlear Inc., PO Box 1421, American Fork, UT 84003.

By participating in the Contest, participants agree to abide by these Official Rules and the decisions of Xlear Inc., which are final and binding in all matters related to the Contest.
